What Is A Personal Injury?

When you are injured in an accident, through no fault of your own with negligence from another person or entity involved, this is known as a personal injury. Although automobile accidents account for a large percentage of personal injury claims, there are many other sources of personal injury claims.

These include:

  • Medical Malpractice
  • Slip And Fall Accidents
  • Dog Bites
  • Premises Liability Injuries
  • Product Liability Claims for dangerous or defective drugs and medical devices or other consumer products

If an accident like this has happened to you, you need guidance from Opelika personal injury attorneys.

The Carmichael Law Group will help you recover medical expenses, lost wages, and compensation for other damages. For example, someone who has a lifelong disability from a personal injury accident can significantly benefit from personal injury representation.

What Is The Statute Of Limitations On Personal Injury Cases In Alabama?

Even if you’re working with a personal injury attorney, your claim must be filed within the statute of limitations. The statute of limitations is the amount of time (from the date of the accident in most cases) in which you can file a claim.

Alabama’s statute of limitations for most personal injuries is two years.

Exceptions do exist, such as the “discovery rule.” In most cases, you know that you have sustained an injury. If you break your leg or are bitten by a dog, it’s evident that you’re injured. In some cases, a person may:

  • Not immediately realize that they’re injured
  • Discover the injury later on

In the scenarios above, the clock for the statute of limitations doesn’t start ticking until the injury is discovered. Working with an experienced attorney in cases involving discovery is recommended because the defense will question how you didn’t know that the injury existed.

If the defense can show that you should have known about your injuries and that the statute of limitations passed, you will not be able to seek the compensation you deserve.

What Compensation Is Available For An Opelika Personal Injury Claim?

If you are injured because of someone else’s negligence, a personal injury attorney can help you pursue compensation for economic and/or non-economic damages.

Economic Damages

Economic damages can include any verifiable and out-of-pocket losses you incur because of the accident. They can include (but are not limited to):

  • Medical expenses, including hospital stays, rehabilitation, specialist visits and even mobility aids.
  • Lost wages if your injuries forced you to take time off of work.
  • Loss of future income. If your injuries are expected to cause you to miss work in the future, you may be entitled to compensation for this loss of income.
  • Property damage to cover the cost of repairs or replacement of items affected by the accident (e.g. your car).

Economic damages are relatively straightforward to calculate, but they make up just a portion of your potential compensatory damages.

Non-economic Damages

Damages that fall into the non-economic category are more complex to calculate. Although intangible, these damages can have a greater impact on your quality of life.

Non-economic damages can include:

  • Pain and suffering
  • Loss of enjoyment
  • Emotional distress
  • Loss of companionship

You may be eligible for some or all of these damages. An experienced personal injury attorney can help you determine what compensation will be available to you and calculate your potential damages.
