Millions in Alabama and Georgia are discovering that the water they rely on every day contains dangerous levels of PFAS. PFAS, also known as "forever chemicals", are man-made substances, used for decades in industrial and consumer products. Research estimates that PFAS exposure through drinking water could contribute to as many as 6,846 cancer cases each year.
These chemicals have infiltrated local water supplies, putting millions at risk. At least four water systems in Alabama have reported PFAS concentrations reaching as high as 40 parts per trillion — ten times the current EPA safety limit. In Georgia, over 1 million could have consumed water containing PFAS. In Calhoun, which reported the highest rates in the state, PFAS levels were 9,500 percent higher than the EPA’s reporting threshold.

From Miracle Chemicals to Toxic Threats: What is PFAS?
PFAS, or per- and polyfluoroalkyl substances, are a group of human-made chemicals that include PFOA, PFOS, and thousands of others. Developed in the mid-20th century, PFAS were celebrated as miracle compounds for their water-repellent, grease-proof, and heat-resistant properties. They’ve been widely used in products ranging from non-stick pans and food packaging to firefighting foam and industrial materials.
Their widespread use has led to a global environmental and health crisis. These chemicals don’t break down easily in nature, persisting in water, soil, and living organisms for decades. It wasn’t until the early 2000s that their harmful effects on human health became evident. Studies began linking PFAS exposure to serious conditions like cancer, immune disorders, and developmental issues in children.
Today, PFAS contamination is found everywhere — from municipal drinking water systems to private wells. Traces even show up in everyday items like makeup and clothing. While their production has been scaled back in the United States, communities remain burdened by decades of contamination.
Who Is Eligible to Join a PFAS Mass Tort?
Mass tort cases unite individuals harmed by similar circumstances into a collective legal fight. However, not everyone automatically qualifies for PFAS injury lawsuits. The legal claim must meet specific criteria to determine eligibility.
You may be able to join a PFAS mass tort claim if you meet these conditions:
- You drank from a water system known to be contaminated with PFAS.
- If you’ve been diagnosed with certain health conditions including testicular cancer, kidney cancer, ulcerative colitis, or liver cancer, you may qualify for a PFAS claim depending on your exposure.
These health problems are closely linked to PFAS exposure. If you suspect contamination but haven’t yet tested your water, it’s worth consulting with an attorney to explore your eligibility.
Statute of Limitations for PFAS Claims
Filing a legal claim requires acting promptly due to the statute of limitations, which imposes deadlines on lawsuits. Once the window closes, your ability to seek compensation is lost. The timeframes vary between states, and understanding how these limits apply in your case is essential.
In Alabama, the statute of limitations for personal injury claims is two years from the date of diagnosis or discovery of harm. For Georgia residents, the deadline is also two years after recognizing the damage caused by PFAS exposure. However, certain exceptions, such as ongoing contamination or delayed discovery, might alter these periods.
Because deciphering deadlines can be complex, consulting legal counsel early is critical. We can evaluate your circumstances, identify applicable timelines, and guide you toward a timely filing.
